DMCA Policy

1. Overview

Marbella AI LLC respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to notices of alleged copyright infringement that comply with the DMCA and are properly submitted to our designated agent.

2. Filing a DMCA Notice

If you believe that your copyrighted work has been copied in a way that constitutes infringement on the SMF-IMG platform, please provide our designated agent with the following information:

• A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
• Identification of the copyrighted work claimed to have been infringed
• Identification of the material that is claimed to be infringing, with sufficient detail to allow us to locate it on the Service (e.g., URL or screenshot)
• Your contact information, including name, address, telephone number, and email address
• A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
• A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf

3. Designated Agent

4. Counter-Notification

If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our designated agent containing:

• Your physical or electronic signature
• Identification of the material that was removed and the location at which it appeared before removal
• A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification
• Your name, address, telephone number, and a statement consenting to jurisdiction of the federal court in your district

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we may restore the removed content.

5. Repeat Infringers

In accordance with the DMCA and other applicable law, we maintain a policy of terminating the accounts of users who are determined to be repeat infringers in appropriate circumstances. We may also, at our sole discretion, limit access to the Service or terminate the accounts of any users who infringe the intellectual property rights of others, whether or not there is any repeat infringement.

6. AI-Generated Content

SMF-IMG uses artificial intelligence to generate images. While our systems are designed to produce original content, AI-generated outputs may occasionally resemble existing copyrighted works. If you believe an AI-generated image on our platform infringes your copyright, please follow the DMCA notice process outlined above. We take all such claims seriously and will investigate promptly.
